Terms of Service
Last updated: 17 August 2026
Welcome to Pixator (https://pixator.app). These Terms of Service ("Terms") govern your access to and use of the Pixator website, tools, and related services (the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Pixator is operated by Dervex ("we", "us", or "our"). These Terms form an agreement between you and the operator of Pixator.
1. Acceptance of Terms
By using the Services, you agree to comply with these Terms, our Privacy Policy, and our Content Policy, as well as all applicable laws and regulations.
2. Changes to Terms
We may modify these Terms at any time. Changes take effect when posted on this page (with an updated "Last updated" date). Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms. If you do not agree, stop using the Services.
3. Eligibility and Accounts
You must be at least 18 years old to use the Services. If you are under 18, you may only use the Services under the supervision of a parent or legal guardian who has reviewed and agreed to these Terms on your behalf.
Accounts are created via Google or Apple sign-in. You are responsible for activity under your account and for keeping access to your sign-in provider secure. We may suspend or terminate access if we believe an account is misused or these Terms are violated.
4. Description of Services
Pixator provides AI-assisted image, video, and sound tools. You upload media or prompts, we send them to third-party model providers for processing, and you may download results. Uploads and results are stored only briefly and are designed to be deleted within about one hour. We do not offer a lasting media library or public gallery.
Anonymous visitors may receive a limited free image edit. Additional use generally requires an account and credits. Video and sound tools may require sign-in. Features, models, pricing, and availability may change without notice.
5. User Content
You retain whatever rights you already have in content you upload, submit, or generate through the Services ("User Content"). You are solely responsible for User Content and for how you use outputs.
You represent and warrant that you have all rights, licenses, and consents needed to upload and process User Content — including rights in likenesses, faces, voices, trademarks, and copyrighted works — and that your use will not violate any law or third-party right.
You grant us a limited, non-exclusive license to host, transmit, and process User Content solely as needed to operate the Services (including sending it to subprocessors such as AI model providers and cloud infrastructure). We do not claim ownership of your User Content and do not use it to train our own AI models.
6. Credits and Purchases
Paid use is billed in virtual credits sold as one-time packs (not a subscription). Credits may be used only for running tools on Pixator. Credits have no cash value, are not redeemable for money or other goods, and are not transferable between accounts except as we expressly allow.
Purchases are processed by Stripe. Except where required by mandatory consumer law, all credit purchases are final and non-refundable once credits are delivered to your account. If a tool run fails without a billable inference cost, reserved credits are typically released back to your balance; that is not a cash refund.
New accounts may receive a promotional credit grant. Promotional and free credits may be revoked or adjusted at our discretion.
7. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms and the Content Policy. You agree not to:
- Interfere with, disrupt, or overload the Services or related systems;
- Attempt unauthorized access to accounts, systems, or data;
- Bypass usage limits, free-edit gates, fingerprinting, or payment controls;
- Scrape, bulk-download, or reverse engineer the Services except as permitted by law;
- Use the Services for any illegal, harmful, or unauthorized purpose.
8. AI Outputs and Third-Party Models
Outputs are generated by automated systems and third-party providers. Results may be inaccurate, biased, incomplete, offensive, or infringing. We do not guarantee that any output is unique, fit for a particular purpose, or free of third-party rights. You are responsible for reviewing outputs before using or distributing them.
Model providers may apply their own safety filters. Content may be blocked or jobs may fail for policy reasons. We are not liable for such filtering or for provider outages.
9. Intellectual Property
The Services — including branding, UI, software, and documentation — are owned by us or our licensors and are protected by intellectual property laws. Except for the limited license to use the Services as provided, no rights are granted to you.
10. Termination
You may stop using the Services at any time. We may suspend or terminate access immediately, with or without notice, for conduct we believe violates these Terms, harms other users, or harms our business, or for operational, legal, or security reasons. Upon termination, your right to use the Services ends. Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnity) will survive.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT MEDIA WILL ALWAYS BE RETAINED OR DELETED WITHIN A SPECIFIC TIME WINDOW.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICES; (B) USER CONTENT OR THIRD-PARTY CONDUCT; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR (D) ANY OTHER MATTER RELATING TO THE SERVICES — WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID US FOR CREDITS IN THE THREE (3) MONTHS BEFORE THE CLAIM AROSE, OR (II) TEN EUROS (€10).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.
13. Indemnity
You agree to indemnify and hold harmless us and our affiliates from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Services, or your violation of these Terms or applicable law.
14. Governing Law
These Terms are governed by the laws of Poland, without regard to conflict-of-law principles. Courts in Poland shall have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction. If you are a consumer in the EU/EEA/UK, mandatory local consumer protections may also apply.
